Buying Spanish property with a power of attorney: how should you prepare from Hungary?

By: SpainProperty editorial team · editorial and sourcing standards

With an appropriate notarial power of attorney, a representative can carry out specified steps of a Spanish property purchase on your behalf. Starting from Hungary, first clarify the required authority, how the document will be prepared and the conditions for its acceptance in Spain. A power of attorney alone does not establish that every purchase step can be completed without travel.

This guide helps Hungarian buyers preparing representation for a Costa del Sol new-build apartment or villa. Choosing the property, legal due diligence, financial decisions and technical handover remain separate tasks. Assign a responsible person and a checkpoint to each.

What is a poder notarial?

Spain’s notarial organisation defines a poder as a public document authorised by a notary appointing a representative for specified legal acts. The representative demonstrates that authority through an authorised copy of the power. Its contents must fit the tasks involved. Source: Consejo General del Notariado, notarial powers of attorney.

Alongside the legal engagement, therefore, separately ask which notarial authority is required. Obtaining documents, signing a contract and making a mortgage-related declaration are different tasks. The draft should identify the actual steps, rather than relying only on the representative’s name and a general reference to “property administration”.

Start by listing the tasks

List the decisions you will make, what the representative will prepare and which declarations they can make. For a new-build, separately ask about reservation, the construction-stage contract, the final notarial purchase deed and tasks connected with taking possession.

  • •Administration: are NIE applications, tax representation or document requests needed?
  • •Contracts: which documents may the representative sign?
  • •Finances: which payment, account or mortgage matters may they handle?
  • •Decision limits: how can the price, selected property and changes requiring prior approval be recorded?
  • •Handover: who receives documents and keys, and who commissions the technical inspection?

This is a preparation checklist, not a ready-to-sign power of attorney. The lawyer and notary preparing the document should formulate the necessary authority and limits. Request an explanation if the draft includes delegated representation or authority extending beyond the purchase.

Three routes for preparing the document

Possible routeWhen should you consider it?What should you agree in advance?
Spanish notaryIf you already plan to travel to SpainRequired draft, identification, language assistance and accepted procedure
Spanish consular route in BudapestIf preparing a power in Hungary for use in SpainOfficial document checklist, NIE, lawyer’s draft and attendance for signing
Hungarian notaryIf choosing this route for Spanish useAcceptance of wording and document form, translation and required authentication

The table is a planning framework; the routes are not interchangeable in every case. First obtain feedback from the notary involved in the Spanish transaction, then arrange preparation using the agreed wording. This allows substantive questions to be resolved before booking the appointment.

Budapest: your NIE position matters too

The Spanish embassy’s Hungarian-language guidance lists the grantor’s valid identity document, a NIE for a foreign grantor, a copy of the representative’s identification and a lawyer-prepared draft among the required documents. Additional information may be requested. Source: Spanish embassy, notarial powers of attorney.

The same page requires an appointment and personal attendance when signing. The process can therefore take place in Hungary, but is not conducted solely by email. Fees also depend on document length, the number of representatives and authorised copies; do not budget from a generic fixed price found online.

If you do not yet have a NIE, mention this at the outset. Do not assume a Budapest purchase power of attorney can always precede resolving the NIE. Alongside the guide to applying for a NIE, have the lawyer and relevant office confirm the current sequence for your chosen procedure.

Hungarian notary: prepare for Spanish use as well

MOKK’s official guidance states that the Hungarian National Chamber of Civil Law Notaries authenticates documents made or certified by Hungarian notaries for foreign use where required. This may be a separate process from preparing the notarial document itself. Source: MOKK, authentication of notarial documents for use abroad.

For the actual document, clarify apostille, language and translation requirements, and which copy the Spanish recipient accepts. Spanish notarial guidance highlights that an apostille authenticates a document’s origin. Separately agree the authority granted in the power. Source: Notariado, international use.

Ask whether an official translation is needed, who may prepare it, which parts it should cover and how it should be attached to the document. Obtain a clear answer on formal acceptance before signing in Hungary and ordering translation. This can prevent avoidable rework, but does not promise one procedure or timeframe for every case.

What should the professional on the Spanish side confirm?

Your own record should answer five questions: the document’s contents, place of preparation, authentication, language and accepted copy. After execution, have it checked that the agreed version was signed, details match and the required authorised copy reached the appropriate participant.

Commission the property’s due diligence alongside the power. The nota simple guide for new-build properties helps organise property identifiers and separately needed documents. Arranging representation and checking the offer are parallel tasks.

Mortgages and payments: a separate line of enquiry

If borrowing, separately clarify the bank’s identification, underwriting and signing requirements. Ask at which step a representative is accepted, with what authority, and whether your personal involvement or participation by another method is required. Do not infer bank acceptance automatically from a purchase power of attorney.

The guide to Spanish mortgages for non-resident buyers helps prepare financing questions. Agree in writing with the representative who receives final documents, who checks amounts due and which decisions require your approval.

Illustrative situation: NIE authority does not establish purchase-signing authority

In an invented preparation plan, a buyer requests authority only to obtain an identification number, then later wants the purchase signed using the same document. The question to resolve is: does the document actually authorise the next act? This is a task-matching exercise, not an actual client story.

Identify the entire intended process in the first draft, rather than discovering a gap immediately before signing. If the property, financing or representative changes, obtain a fresh legal check of what remains usable and what needs amending. All participants should record the same document version and date.

Assign responsibility for technical handover and later representation

For a remote purchase, name who will inspect the actual home, produce the defects list and check repairs. Specify which discrepancies require an immediate report. The new-build property handover checklist provides a practical framework.

After completion, discuss whether representation is still required. Spanish notarial guidance explains the possibility of revoking a power and notifying the representative. Clarify the actual steps with a notary or lawyer. Source: Notariado, revocation of a power.

Takeaway: what should a remote purchase rest on?

A precise task list, appropriate authority, an agreed document route, confirmed acceptance and separately organised property checks. If a condition remains unresolved, keep preparation of the representation open. The official guidance linked here was checked on 20 October 2026.

In a Hungarian-language consultation with SpainProperty, mention where you will handle administration from, whether you already have a NIE and when you could travel, alongside location, budget and purchase purpose. The search for Costa del Sol new-build offers and preparation of the next steps can then be planned together.
