1. Data Controller

Data processing under this policy is carried out by Performoon OÜ (registry code: 17001386, registered address: Ahtri tn 12, 15551 Tallinn, Harju maakond, Estonia), which operates this website and acts as data controller. Contact: office@performoon.com.

2. Data We Process

Through the contact form you provide: name, phone number, email address, investment budget, preferred location, purchase purpose and timeframe, and the content of your message. In addition, the website collects technical data via cookies (e.g. IP address, browser and device information, traffic and campaign parameters).

3. Purposes and Legal Bases of Processing

• (a) Responding to your enquiry and preparing a personalised offer — pre-contractual steps at your request, GDPR Article 6(1)(b).
• (b) Sharing your data with our contracted real estate sales partners for the purpose of making an offer — your consent, GDPR Article 6(1)(a).
• (c) Sending newsletters and marketing communications — your consent, GDPR Article 6(1)(a).
• (d) Analytics and advertising processing — your consent given in the cookie banner, GDPR Article 6(1)(a).

4. Recipients

We share your data with our contracted real estate sales and advisory partners, who may use it solely to prepare and present offers to you. The current list of recipients is available from the data controller upon request.

5. International Transfers of Data

Some of our contracted partners also operate outside the European Union, in the United Arab Emirates (UAE). The European Commission has not adopted an adequacy decision for the UAE, so EU data protection law (GDPR) does not directly apply to those partners, and EU-level data protection safeguards do not automatically apply.

The legal basis for transfers to such non-EU partners is your explicit consent under GDPR Article 49(1)(a), given by submitting the contact form, sending a WhatsApp message, or booking a consultation slot. You may withdraw this consent at any time using the contact details below.

6. Contact via WhatsApp and Booking

When you contact us via WhatsApp or book a consultation slot on Cal.com, we process the data you provide (name, phone number, email address, message content, booking details) in order to respond to your enquiry and prepare an offer, based on GDPR Article 6(1)(b) (pre-contractual steps taken at your request).

"By sending a WhatsApp message or booking a consultation slot, you accept this Privacy Policy and consent to sharing your data with our contracted real estate sales partners — including partners operating outside the European Union — who may contact you to make an offer."

The retention periods, categories of recipients and data subject rights set out elsewhere in this policy apply equally to such enquiries.

7. Retention

We retain leads for 24 months from the last contact, after which they are deleted. Data evidencing the giving of consent (timestamp, text version, page URL) is kept for a reasonable period thereafter for the purpose of demonstrating compliance.

8. Processors

We use the following processors in connection with the processing:

• Supabase — database and hosting.
• Resend — transactional email delivery.
• Brevo — email marketing campaigns.
• Google — analytics and advertising (Google Analytics, Google Ads).
• Cal.com — consultation booking.
• Meta / WhatsApp — messaging. WhatsApp communication is subject to Meta's own data practices, which may include processing outside the European Union.

9. Your Rights

You have the right to access, rectify, erase, restrict processing, data portability, and to withdraw consent at any time. Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal. You may also object to processing based on legitimate interests.

You may withdraw your consent at any time by emailing office@performoon.com.

You may lodge a complaint with the Estonian Data Protection Inspectorate, Andmekaitse Inspektsioon (www.aki.ee), as well as with the Hungarian National Authority for Data Protection and Freedom of Information (NAIH, naih.hu).

10. Deletion Requests

You can send deletion requests to office@performoon.com. We fulfil legitimate deletion requests within 30 days of receipt.
