Community fees for a Spanish new-build: what does the comunidad charge include?

By: SpainProperty editorial team · editorial and sourcing standards

For a Spanish new-build apartment, check community fees against the budget, cost-allocation rules and service list for the actual unit. An advertised monthly comunidad charge alone does not show whether it is an estimate or an approved amount, or whether reserve-fund payments or special levies are additional.

This matters particularly in Costa del Sol developments where shared gardens, a pool or other facilities may form part of the offer. This checklist is for Hungarian buyers considering a new-build apartment in Andalusia. It is not a community-fee price list: two homes with similar purchase prices can have different ownership costs.

What does comunidad mean, and what are you paying for?

The comunidad de propietarios is the community of owners; the cuota de comunidad is the contribution paid to it. Look for cleaning, gardening, pool operation, lift maintenance, communal electricity, insurance and administration in the budget. These are items to check, not a service package that applies to every development. The guide to comparing Spanish home and community insurance provides a separate document checklist to establish what protects your own apartment.

When comparing charges, record the level of service too. Periodic gardening and permanent on-site staff can imply different cost structures. Ask about pool opening hours, heating, security duties and any wellness facility’s access conditions. A rendering does not replace an operating specification.

Keep in-home consumption and the owner’s other annual expenses on separate lines unless a document confirms that an item is included in the community charge. The guide to Spanish property costs and taxes provides an overview of the categories; verify the amounts for the actual property.

An estimate or an approved annual budget?

During construction, request the preliminary budget, its preparer, date and assumptions in writing. If the community is already operating, look for the approved annual plan and the corresponding meeting minutes. Do not compare a start-up budget covering part of a year directly with twelve months of full operation. Ask whether the pool, gardens and all blocks are operating during that period. If the developer temporarily covers an expense, request the amount, duration and conditions under which that commitment ends.

Take this document checklist into the purchase process

Item to checkWhat should you request in writing?
Selected propertyUnit identifier; treatment of parking and storage charges
Annual budgetPeriod, total amount and whether estimated or approved
Cost allocationConstitutive title, any statutes, and applied allocation rules
ServicesWhat operates, from when, at what level, and what costs extra?
Reserve and one-off paymentsWhether included; purpose, amount and due dates
Start of paymentsStart date, monthly or other schedule, and any apportionment

This is a buyer’s checklist, not a claim that every document already exists at every stage of a development. In Andalusia, Article 6 of Decree 218/2005 requires the DIA information document for homes marketed during construction to describe shared areas and associated services. Request a specific delivery schedule for community documents that are still outstanding. Source: Junta de Andalucía, Decree 218/2005.

Why can you not simply divide the bill by floor area?

Contributions to general shared expenses follow the share in the constitutive title or the specially established rules. Do not replace that allocation with your own floor-area calculation. Source: Articles 5 and 9 of Spain’s Horizontal Property Act.

Request a calculation completed for your selected unit: which percentage was applied to each annual expense? How were the garage, storage room or a separate service treated? The guide to Spanish apartment floor areas helps with reading plans, but for community charges request the allocation rules in the documents.

For a larger complex, clarify both the building and wider development levels: the Act also allows groups of separate communities. Source: Horizontal Property Act, Article 24. Ask whether the quoted fee includes every level. Do not automatically assume golf or club access is included.

Worked example: €120 a month, but on what assumptions?

These figures are invented planning assumptions, not market averages, quoted fees or details of an available development. Suppose the defined annual community budget is €192,000, and 0.75% applies to the apartment for that budget. For this example, the budget already includes every ordinary item being assessed and the planned reserve contribution; there is no other community charge.

  • •Annual share: €192,000 × 0.0075 = €1,440.
  • •Monthly equivalent: €1,440 ÷ 12 = €120. This does not establish that collection is monthly.
  • •Separate assumed one-off contribution: €24,000 × 0.0075 = €180, if that allocation also applies to this item.
  • •Total annual community payment in the example: €1,440 + €180 = €1,620.

Check how much room your budget has, too. If you use an annual community budget 15% higher solely as your own scenario, €220,800 × 0.0075 gives €1,656, equivalent to €138 a month. The difference is €216 a year or €18 a month. The 15% is not a forecast: it shows how a changed assumption would affect your own financial headroom.

Reserve funds and derramas: two separate questions

The fondo de reserva is the community’s reserve fund; a derrama can appear as a separately levied contribution. Specific initial-funding rules apply to a new community, so check the amount and funding schedule. Source: Horizontal Property Act, Article 9 and first additional provision.

Ask about the fund’s existing balance, planned contributions and whether these have already been included in the quoted fee. This avoids counting the same item twice. For an extraordinary payment, request its purpose, amount, allocation, due dates and supporting document. The buyer’s lawyer should clarify payment responsibility for the actual transaction from those documents.

What if you only use the apartment for a few weeks a year?

For general shared expenses, not using a service does not in itself remove the payment obligation; statutory exceptions need separate assessment. Source: Horizontal Property Act, Article 9(2). Do not automatically reduce your planned comunidad payment in proportion to the weeks you spend there.

For a development handed over in phases, ask separately about contributions for unsold units, services at start-up and the cost of facilities opening later. Do not assume that completion of another phase automatically reduces your fee. Record the cost you are committing to now separately from any possible later change.

Keep the handover document list alongside your first-year financial plan. The guide to taking delivery of a Spanish new-build provides a practical framework. Checking the budget and inspecting the property are separate tasks.

Takeaway: when can you compare two community fees?

When they cover the same period, known services and the allocation that applies to the actual unit. Record estimates, approved charges and one-off payments separately. If material information is missing, keep the ownership cost marked as awaiting verification. The official sources linked here were checked on 16 October 2026.

In a Hungarian-language consultation with SpainProperty, mention your annual ownership-cost budget and intended use alongside your purchase budget. Shared services and their costs can then form part of comparing Costa del Sol new-build offers.
